Terms and Condition of Sales
for Investment Timber Trees
Upon Submission of your order and checkout process is complete, your order is processed
and removed from inventory and your credit card is charged immediately.
Returns
All sales are final.
Guarantee
Advanced Tree Technology guarantees that the plants supplied will be in live and
healthy condition for growing. If plants are found not to be in this condition contact
Advanced Tree Technology immediately at 260-749-0891. We cannot guarantee to keep
plants alive at all adds. Once plants have left our control it is up to you the
grower to look after them properly and to follow the provided instructions.
Grafts
Dormant grafts that do not leaf out by July 1 of the year in which they are planted
will be replaced one time free excluding shipping. Grafts that leaf out by July
1 of the year in which they are planted but fail within 24 months of pick up or
shipping will be replaced at $10.00 each, plus shipping.
Approved Protectors
Protectors/Miracle Tube use is required on all grafted trees for our guarantee to
be in effect.
Superior Seedlings
Superior seedlings that fail to leaf out by July 1 of the year in which they are
planted will be replaced one time free of charge excluding shipping. Superior seedlings
that leaf out by July 1 of the year planted but fail within 24 months of pick up
or shipping will be replaced for $1.00 each, plus shipping.
Advanced Tree Technology may request that the plants or trees being claimed as a
loss be returned to our company at purchaser’s expense, or we may request pictures
(print or digital) of the claimed materials. Replacement trees will be provided
the year following the claim. Dormant trees that fail to leaf out must be documented
and reported to Advanced Tree Technology by July 31 of the trees’ first growing
season. Our replacement policy is limited to a one-time replacement and excludes
all shipping costs. Written notice must be given the proprietors within the stated
time and include the original shipping label. We do not guarantee plants against
neglect, animal, human or insect damage, misuse of fertilizer or herbicides, vandalism,
growing error, extreme weather or natural disaster. Plants must be planted in their
proper stated growing zone. The proprietors will not be held responsible for courier
error or delivery difficulty due to insufficient address.
EXCEPT AS SET FORTH ABOVE, ADVANCED TREE TECHNOLOGY DOES NOT MAKE ANY REPRESENTATIONS
OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF
FITNESS OR MERCHANTABILITY REGARDING ANY PRODUCT PURCHASED FROM ADVANCED TREE TECHNOLOGY,
AND ADVANCED TREE TECHNOLOGY SPECIFICALLY DISCLAIMS ANY AND ALL SUCH WARRANTIES.
THE REMEDIES SET FORTH ABOVE CONSTITUTE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE
TO YOU. ADVANCED TREE TECHNOLOGY SHALL NOT, IN ANY EVENT, BE LIABLE FOR DAMAGES
IN AN AMOUNT GREATER THAN THE ORIGINAL PURCHASE PRICE OF ANY PLANT. IN NO EVENT,
SHALL ADVANCED TREE TECHNOLOGY BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL,
OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT BY WAY OF LIMITATION, ECONOMIC LOSSES
AND LOSS PROFIT) INCURRED OR CLAIMED BY YOU.
This written warranty supersedes any verbal guarantee given or implied.
